These general terms and conditions apply to all quotes, contracts and works of SEVER Bouw & Constructie (company number BE 1042.514.230), unless agreed otherwise in writing. By signing a quote, the client accepts these terms.
These terms apply to every contract between SEVER Bouw & Constructie and its clients, to the exclusion of any of the client's own terms, unless expressly agreed otherwise in writing.
Quotes are valid for 30 calendar days from their date, unless stated otherwise. The contract is only formed once the client has signed the quote in writing.
Prices are exclusive of VAT unless stated otherwise. Payment is made in instalments: 30% deposit upon signing the quote, 40% at the start/midpoint of the works, and the 30% balance upon completion, unless agreed otherwise in the quote. In case of late payment, late-payment interest is due automatically and without prior notice, in accordance with the Act of 2 August 2002 on combating late payment.
Execution periods are given as an indication and do not constitute an obligation of result, unless expressly agreed otherwise. Delays due to force majeure, weather conditions, late decisions by the client, or additional works may extend the period without any right to compensation for the client.
Additional works, or works not provided for in the quote, are only carried out after prior written agreement from the client on the additional cost and any impact on the execution period.
The works are handed over upon completion, in the presence of both parties. Visible defects must be reported in writing at handover; hidden defects within a reasonable period after discovery. In the absence of written remarks within these periods, the works are deemed accepted.
SEVER Bouw & Constructie is liable for defects in the works performed under common law, subject to the ten-year (decennial) liability referred to in Article 8. Liability for indirect damage (e.g. consequential loss, loss of profit) is excluded, except in case of intent or gross negligence.
Under the Act of 31 May 2017 (the "Peeters-Ninanne/Borsus Act"), contractors are required to take out ten-year liability insurance for works that may affect the stability, strength or watertightness of the closed shell of a building intended primarily for residential use. Whether this insurance obligation applies to a specific project is indicated in each quote; where applicable, SEVER Bouw & Constructie will provide the insurer's name and policy number in writing before the works start.
Neither party is liable for a failure resulting from force majeure (e.g. extreme weather conditions, material shortages, government measures). In that case, the execution period is automatically extended by the duration of the force majeure event.
Delivered materials remain the property of SEVER Bouw & Constructie until full payment of the agreed price, even if already incorporated into the property, insofar as legally possible.
If the quote is signed by a consumer outside the business premises of SEVER Bouw & Constructie (e.g. at the client's home), the client has, in accordance with Book VI of the Belgian Code of Economic Law, a withdrawal period of 14 calendar days from signing, without giving reasons and free of charge. To exercise this right, the client must inform SEVER Bouw & Constructie in writing (post or e-mail: info@severbouw.com) before this period expires. If the client expressly and in writing requests that works start before the withdrawal period expires, the right of withdrawal lapses once the contract has been fully performed; in case of withdrawal during performance, the client owes an amount proportional to what has already been supplied.
In case of failure to meet an essential obligation by either party, the other party may terminate the contract, subject to prior written notice of default that remains unaddressed within a reasonable period.
Complaints about the execution of the works can be sent to info@severbouw.com; SEVER Bouw & Constructie aims to respond to every complaint within a reasonable period. Consumers may also contact the Consumer Ombudsman Service (consumerombudsman.be).
Belgian law applies to these terms and to every contract. Disputes are settled amicably where possible; failing agreement, the legally competent court of the consumer's domicile has jurisdiction, without prejudice to mandatory legal provisions in favour of the consumer.
Should any provision of these terms prove invalid or unenforceable, the remaining provisions remain fully applicable. These terms may be amended by SEVER Bouw & Constructie; the applicable version is the one provided to the client with the quote, or the most recent version on this page for contracts without a separate quote.
